1. About These Terms

These Terms of Service ("Terms") govern your use of the OzShoppa website located at ozshoppa.com.au (the "Website"), operated by OZSHOPPA PTY LTD ABN 59 702 939 544 ("OzShoppa", "we", "us", "our").

By accessing or using the Website, you agree to be bound by the current version of these Terms. We may update these Terms from time to time. The current version will be published on this page with its revised date.

2. About OzShoppa

OzShoppa operates as a product-discovery and affiliate/referral platform. We curate and present product information and connect customers with participating third-party retailers through affiliate and referral links.

OzShoppa does not operate an online checkout and does not sell products directly to customers. When you follow a link from the Website to a participating retailer, you leave the OzShoppa Website and interact with that retailer's own platform under that retailer's own terms and conditions.

3. Your Purchase Relationship With Participating Retailers

When you click an affiliate or referral link on the Website and make a purchase, the transaction is solely between you and the participating retailer. The retailer is responsible for:

product pricing and availability;
processing your order and payment;
order fulfilment and delivery;
returns, refunds and exchanges;
warranties and product guarantees; and
all purchase-related customer service.

OzShoppa is not a party to your purchase transaction with any participating retailer. The retailer's own terms and conditions govern the retail transaction. Nothing in these Terms excludes or limits any responsibility that OzShoppa itself cannot lawfully exclude, including responsibility for its own representations or conduct.

If you have a query or dispute regarding a purchase, you should contact the relevant retailer directly.

4. Affiliate and Referral Relationships

OzShoppa participates in affiliate and referral programs. When you follow a link from the Website to a participating retailer and a qualifying event occurs (such as a purchase), OzShoppa may receive a commission or other benefit from the retailer or an affiliate network.

Featuring a product reflects OzShoppa's product-discovery and editorial selection process, but does not guarantee that the product will suit every customer, purpose or location, or that a participating retailer will maintain a particular price, stock level or service outcome.

5. Product Information, Pricing and Availability

Product information on the Website — including descriptions, images, specifications, pricing and availability — may be based on information provided by manufacturers, participating retailers, suppliers, affiliate networks or other available sources. OzShoppa may also add its own editorial descriptions, selection rationale or contextual information.

OzShoppa aims to keep product information accurate and current. However, prices, specifications, stock levels and retailer terms can change without notice. You should verify current pricing, availability and product details directly with the relevant retailer before making a purchase decision.

Where OzShoppa identifies a material error in information it has published, we will take reasonable steps to correct it.

The Website contains links to participating retailer websites and other external websites. OzShoppa does not operate or control participating retailers' websites and does not guarantee their availability, systems, policies or performance.

Once you follow a link to a retailer's website, that retailer's own terms and conditions and privacy policy apply to your use of their website and to any purchase you make. We encourage you to read those documents carefully before completing any transaction.

7. Intellectual Property

OzShoppa's name, logo, original editorial content, website design and other material owned by or licensed to OZSHOPPA PTY LTD are protected by Australian and international intellectual property laws. Third-party brand names, product names, trade marks, product images and other materials displayed on the Website remain the property of their respective owners or licensors.

You may view and use the Website for your own personal, non-commercial purposes. You must not, without our prior written consent:

reproduce, copy, distribute or republish OzShoppa's original content or website design;
modify or create derivative works from OzShoppa's owned or licensed content;
use OzShoppa's trade marks, logos or branding; or
scrape, data-mine or systematically extract content from the Website.

Nothing in these Terms transfers any intellectual property rights to you.

8. Acceptable Use

You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the Website.

OzShoppa is not a party to the retail purchase transaction between you and a participating retailer and is not responsible for the retailer's performance of that transaction, including in relation to product quality, fulfilment, delivery, returns, refunds or warranties. Consumer rights relating to a product purchase are ordinarily exercised against the participating retailer that sold the product.

To the extent permitted by law, OzShoppa is not responsible for loss or damage arising from:

your use of, or inability to access, a third-party retailer's website or systems;
changes to a retailer's pricing, availability or terms after you have viewed that information on the Website; or
circumstances outside OzShoppa's reasonable control.

Nothing in this section excludes or limits OzShoppa's responsibility for its own conduct where that responsibility cannot lawfully be excluded or limited. Any limitation of liability applies only to the extent permitted by applicable law.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or other applicable law.

Consumer rights relating to the actual product sale are ordinarily exercised against the participating retailer that sold the product.

13. Governing Law

These Terms are governed by the laws of Western Australia and the applicable laws of the Commonwealth of Australia.
